1. According to Article 11 of the Federal Law of May 27, 1998 No. 76-FZ "On the status of military personnel" The total duration of the weekly service life of military personnel undergoing military service under the contract, except in the cases specified in paragraph 3 of this article, should not exceed normal duration weekly working time established by federal laws and other regulatory legal acts Russian Federation; Attracting these servicemen to the execution of military service duties over the established duration of the weekly service time in other cases is compensated by the rest of the relevant duration on other days of the week; If it is impossible to provide this compensation, the execution of military service duties over the established duration of the weekly service time is summed up and provided with servicemen in the form of additional recreation days, which can be attached at the request of the specified servicemen to the main vacation; The procedure for accounting for official time and the provision of additional holidays is determined by the Regulations on the procedure for the passage of military service (paragraph 1); martial duty (combat service), exercises, hiking of ships and other events, the list of which is determined by the Minister of Defense of the Russian Federation (the head of another federal executive body, in which the Federal Law provides for military service), are carried out if necessary, without limiting the total duration of weekly service time; An additional day of rest compensating for military personnel participation in these events accountable and additional vacations not counted and are provided in the order and on the conditions that are determined by the Regulations on the procedure for the passage of military service; servicemen undergoing military service under a contract involved in events, which are carried out if necessary, without limiting the total duration of weekly service time, at their request, instead of providing additional holidays, cash compensation may be paid in the amount of monetary content for every additional day of rest; The procedure and conditions for payment of monetary compensation are established by the head of the federal executive body, in which the Federal Law provides for military service (paragraph 3).
At the same time, the same article provides that military personnel undergoing military service in the compounds and military units of constant readiness translated in the prescribed manner for the recruitment of military personnel under the contract, additional holidays in accordance with paragraphs 1 and 3 of this article are not provided (item 3.1). The constitutionality of this submit is disputed in the complaint of a citizen I.A. Markov, who held military service under a contract in the rank of senior ensign in the military unit 6832, which, as followed from the submitted materials, from January 1, 2007 refers to military units of constant readiness translated on military positions by military personnel by the military service under the contract.
In 2003-2012, I.A. Markov, being in official business trips in the Chechen Republic, the Republic of Ingushetia and the Republic of Dagestan, participated in hostilities (the total period of its participation in hostilities amounted to 445 days). From October 14, 2013, he was early dismissed from military service based on the basis of sub-clause "b" of paragraph 3 of Article 51 of the Federal Law of March 28, 1998 No. 53-FZ "On Military Duty and Military Service" (for health state - in connection With the recognition of the military-medical commission is limited to military service), and from November 1, 2013, excluded from the lists of the personnel of the military unit.
Believing that when dismissal, the calculation with it was not fully paid - no money compensation was paid to the provision of additional holidays over the period of stay in official business trips and participation in hostilities, I.A. Markov turned to the commander of the military unit 6832 with a statement on the calculation and payment of this compensation, but he was refused to satisfy the application.
Arkhangelsk Garrison Military Court by decision of January 21, 2014, left unchanged by the appeal definition of the Northern Falls of the Military Court of March 19, 2014, refused I.A. Markov in meeting the application for challenging the actions of the commander of the military unit associated with the publication of the order to exclude it from the list of personnel of the military unit without ensuring cash contents in full and with the refusal to pay the specified compensation. Definition of the judge of the Northern Fleet of Military Court of May 21, 2014 I.A. Markov denied the transfer of his cassation complaint to consideration at a meeting of the court of cassation.
In court decrees, in particular, it was indicated that in accordance with paragraph 3.1 of Article 11 of the Federal Law "On the Status of Servicemen" and Article 221 of the Charter of the Internal Service of the Armed Forces of the Russian Federation (approved by the Decree of the President of the Russian Federation of November 10, 2007 No. 1495), military personnel, held military service in the compounds and military units of constant readiness, translated in the prescribed manner for recruiting military service under the contract, additional rest in case of bringing them to the fulfillment of military service responsibilities on working days in excess of the time-established weekly service time, as well as participation in events held without limitation of the total duration of weekly service time is not provided; Since the military unit 6832 from January 1, 2007 is attributed to parts of constant readiness, there are no grounds for the provision of I.A. Markov optional days rest, and therefore, the possibility of paying monetary compensation over these days; In addition, I.A. Markov, by contacting the court on January 9, 2014, missed as provided for in Article 196 of the GC of the Russian Federation, the total limit of reference to the claim on compensation for the period from 2003 to January 9, 2011 and established by Article 256 of the Civil Procedure of the Russian Federation to court with a statement about challenging the actions of an official; No evidence of respect for the reason for the skipping of this term he did not introduce.
According to the applicant, paragraph 3.1 of Article 11 of the Federal Law "On the Status of the Servicemen" admits the inequality of military personnel, since it puts those who undergo military service in the compounds and military units of constant readiness, in the worst position compared to other categories of servicemen in matters of law For an additional rest or receipt of cash compensation, instead of providing additional holidays in attracting the responsibilities of military service, over the established duration of the weekly service time, and thereby contradicts articles 2, 7, 19 (parts 1 and 2), 45 (part 1), 55 , 59 (parts 1 and 2) and 71 (points "B" and "M") of the Constitution of the Russian Federation.
2. The Constitutional Court of the Russian Federation in its decisions, in particular in the decrees of December 26, 2002 No. 17-P, on May 17, 2011 No. 8-P and on March 21, 2013 No. 6-P, noted that military service, By concluding a contract for the passage of which, a citizen implements the constitutional right to free disposal with its abilities to work and the choice of the kind of activity is a special kind of civil service directly related to the provision of defense of the country's country and security and, therefore, carried out in public interests, and persons carrying military service perform constitutionally significant functions.
The special nature of military service as a separate type of federal state service is due to its specific purpose - to protect state sovereignty and territorial integrity Of the Russian Federation, to ensure the security of the state, reflect the armed attack and fulfill the tasks in accordance with international obligations Of the Russian Federation, which, according to part of the first article 26 of the Federal Law of May 27, 1998 No. 76-FZ "On the status of military personnel", is a creature of military debt, which predetermining the content of common, official and special responsibilities of military personnel.
Accordingly, the objectives of maintaining the combat capability of military units at a high level, the fulfillment of the tasks of ensuring the defense of the country's and security of the state are predetermined and the possibility of introducing special, distinct services provided for other categories of civil servants, including in terms of the implementation of military personnel.
At the same time, carrying out in accordance with Articles 59 (Part 2) and 71 (points "M" and T ") of the Constitution of the Russian Federation, the legal regulation of relations related to the passage of military service, the federal legislator is obliged to provide a balance between constitutionally protected values, public and in particular interests, following the principles of justice, equality and proportionality, arising from the Constitution of the Russian Federation, and the norms entrusted to them must meet the criteria for certainty, clarity, unequivocity and consistency with the system of active legal regulation.
2.1. Enchantable in the Constitution of the Russian Federation. The right of everyone to rest (Article 37, Part 5), which includes and provided for by Article 24 of the Universal Declaration of Human Rights The right to leisure and reasonable restriction of the working day, is designed to ensure the restoration of the human body after the workloads associated with the work (service ) than not only further ensures effective execution assigned to the face of labor (service) duties, but also the preservation of human physical and mental health, intellectual and moral development of the individual. The right to rest creates the prerequisites for the realization of other human rights and freedoms, in particular the rights to protect health, the rights to education, the right to participate in the activities of public associations, rights in the field physical culture and sports and others.
Being aimed at ensuring each citizen the ability to restore the ability to produce work or other socially useful activities, through which the right to work is being implemented, the constitutional right to rest has a versatile nature, and the features of military service, although they allow the establishment of special rules (mechanisms) of the implementation of this Rights, however, do not imply its excessive and noncompensated limitations.
2.2. Connections and military units of constant readiness are completed with military personnel who have concluded a contract for military service and thereby voluntarily started to implement the relevant professional activity. The official responsibilities of military personnel and parts of constant readiness are aimed at achieving special results of combat training, which allows them at any time immediately proceed to the implementation of tasks assigned to them.
Thus, in itself, consolidating for this category of military personnel of increased requirements, including intensity of combat training activities and entail certain features of the realization of the right to rest, as well as the establishment of special rules and forms of compensation for them when performing military service responsibilities outside the established Duration of weekly service time, i.e. When attracting the responsibilities of military service over the established duration of weekly service time, as well as participation in activities that are carried out if necessary, without limiting the total duration of weekly service time, differing from those rules and forms of compensation, which are provided for other categories of military personnel, does not mean violations They are right and cannot be considered as not consistent with the requirements of the Constitution of the Russian Federation their limitation.
Determining the forms of compensation to military personnel of increased loads If they need to fulfill their responsibilities of military service outside the established duration of the weekly service time - the prerogative of the legislator and the authorities of the executive bodies, which can for military units performing special tasks, provide for the compensation of relevant cash payments (for example, Increased salary, special allowance or surcharge in cash contents, etc.) or other provisions in return for additional days of rest, but due to the universal nature of the constitutional right to rest, they are not entitled, regulating the official time and recreation time of military personnel, held military service under the contract, Enter such rules that would provide for the fulfillment of military service responsibilities outside the established duration of weekly service time without any compensation.
The presence of state authorities that implement authority in the field of military service, the obligations in one form or another to compensate for the servicemen to fulfill the duties of military service outside the established duration of the weekly service time has previously noted the Constitutional Court of the Russian Federation in its decisions. So, in relation to the legal situation associated with the provision of a serviceman of the right to compensation for the fulfillment of their military service duties over the established duration of the weekly service time during a business trip, the Constitutional Court of the Russian Federation indicated that the exception from the list of activities, which are carried out if necessary, without limiting a total duration weekly service time of military personnel (approved by order of the Minister of Defense of the Russian Federation dated November 10, 1998 No. 492), paragraph 8, which included the following activities, finding in official business trips, in itself does not mean that the involvement of servicemen passing military service under the contract, The fulfillment of military service duties over the established duration of weekly service time can be carried out without relevant compensation (definition of June 24, 2014 No. 1366-O).
3. In order to create the necessary conditions for the implementation by persons held by the military service under the contract, the right to rest the federal legislator in Article 11 of the Federal Law "On the Status of Servicemen" provided for a number of guarantee provisions that secure the total duration of weekly service time and determine the mechanism of providing them For an additional day of rest, both in case of attraction of military service duties over the established duration of weekly service time, and with the participation of them in combat duty (combat service), exercises, campaigns of ships and other events carried out if necessary without limiting the total duration of weekly service time By establishing in the case of participation in such events, the possibility of paying for a serviceman instead of providing additional recreation hours in the amount of monetary content for every additional day of rest (Paragraphs 1 and 3).
In the exclusion of the military service to military service in the compounds and military units of constant readiness, translated in the prescribed manner for the recruitment of military personnel under the contract, under paragraph 3.1 of this article, an additional rest in accordance with paragraphs 1 and 3 of this article is not provided. . At the same time, due to paragraph of the first paragraph 4 of the same article, the military personnel of these compounds and military units are provided for no less than one day of recreation weekly; In accordance with the second paragraph of this point, rest days are provided with military personnel on weekends and holidays, and when they attract them these days to the fulfillment of military service responsibilities, rest is provided on other days of the week.
3.1. The applicant's challenged clause 3.1 of Article 11 of the Federal Law "On the Status of the Servicemen" was introduced by the Federal Law of April 26, 2004 No. 29-FZ "On Amendments to Selected legislative acts Of the Russian Federation ", aimed at creating the legislative framework for the transition to the acquisition of compounds and military units of constant readiness by military personnel under the contract, and to improve the combat readiness of these compounds and military units, and in fact, to implement the provisions of the Federal Target Program" Transition to The acquisition of military personnel by the military service under the contract, a number of compounds and military units "for 2004-2007, approved by the Decree of the Government of the Russian Federation of August 25, 2003 No. 523.
In order to compensate for the specified category of servicemen with additional limitations and loads due to the nature of military service in the compounds and military units of constant readiness, including those associated with participation in activities carried out without limiting the total duration of weekly service time, the same federal law item 4 of Article 13 The federal law "On the status of military personnel" was supplemented by the Regulation, according to which the differentiated surcharge for the special conditions of combat training in the amount established by the Minister of Defense of the Russian Federation (the head of the other federal executive body, in which the Federal Law provides for military service), in The procedure determined by the Government of the Russian Federation.
Thus, for the specified category of servicemen, a special form of compensation was introduced due to the fulfillment of the responsibilities of military service outside the established duration of the weekly service time, differing from compensation provided in accordance with paragraph 1 of Article 11 of the Federal Law "On the status of military personnel" by a military personnel passing Military service under the contract, while engaging for the fulfillment of military service duties over the established duration of weekly service time and from clause 3 of this article compensation for participation in activities carried out if necessary, without limiting the total duration of weekly service time.
The choice of such a form of compensation due to the peculiarities of military service in compounds and military units of constant readiness and related to the sphere of discretion of the federal bodies of state authorities, carrying out the legal regulation of military service, cannot be considered as an arbitrary and contrary to the constitutional principle of equality.
3.2. Federal Law of August 22, 2004 No. 122-FZ "On Amendments to Legislative Acts of the Russian Federation and recognition by invaliding certain legislative acts of the Russian Federation in connection with the adoption of federal laws" On Amendments and Additions to the Federal Law "On general principles Organizations of legislative (representative) and executive bodies of state authorities of the constituent entities of the Russian Federation "and" On the general principles of organizing local governments in the Russian Federation ", namely, paragraph 6 of its article 100, paragraph 4 of Article 13 of the Federal Law" On the status of servicemen "was set forth in the new The editors did not contain more references to a special compensation mechanism for military personnel of military units of constant readiness.
At the same time, paragraph 3 of the Resolution of the Government of the Russian Federation dated December 26, 2005 No. 808 "On the procedure and amounts of payment of monetary compensations instead of annual provision of sanatorium treatment and organized rest and instead of providing the right to free travel to the place of use of the main vacation and back, As well as payouts for the special conditions of combat training with servicemen undergoing military service under the contract in compounds and military units of constant readiness, "the payment of differentiated surcharges for the special conditions of combat training was provided, the specific amount of which was established by the Minister of Defense of the Russian Federation (the head of another federal executive authority, In which the law provides for military service), depending on the complexity, volume and importance of the tasks being performed.
Order of the Ministry of Internal Affairs of the Russian Federation of February 2, 2004 No. 56 "On the establishment of a monthly allowance for special conditions for combat training special categories The internal troops of the Ministry of Internal Affairs of the Ministry of Internal Affairs of Russia "were determined the dimensions of the monthly surcharge for the special conditions of combat training by the servicemen of the internal troops of the Ministry of Internal Affairs of Russia (to which the applicant also treated). This order, as follows from its content, was published in accordance with Article 13 of the Federal Law "On the Status of Servicemen" and Decisions of the Government of the Russian Federation of August 25, 2003 No. 523 "On the Federal Target Program" Transition to the recruitment of military personnel under the contract under contract , A number of compounds and military units "for 2004-2007", which confirms the identity of the differentiated surcharges established by them for the special conditions of combat training.
Thus, the legal regulation, which operated in the period 2004-2011, provided for compensation to the servicemen undergoing a contract in compounds and military units of constant readiness, in the fulfillment of military service duties outside the established duration of weekly service time through establishing and paying them differentiated surcharges for Special conditions for combat training. This surcharge, as indicated in the response to the request of the Constitutional Court of the Russian Federation, obtained from the military unit 6832, was paid monthly by I.A. Markov from January 1, 2007 to December 31, 2011 in the amount of 3,300 rubles.
3.3. In connection with the comprehensive monetary reform held in 2011-2012, the Federal Law of November 7, 2011 No. 306-FZ "On the monetary content of military personnel and the provision of individual payments", adopted for the purpose of forming a new Monetary content systems with an ordered set of additional payments, coefficients and allowances for monetary content of military personnel, registered acts that have established surcharges for special conditions of combat training have been rapidly raised. Meanwhile, the approach of the legislator, in which the peculiarities of the military service of military service under the contract, including special conditions of service in the compounds and military units of constant readiness (related, among other things, with the need to fulfill the duties of military service outside the established duration of weekly service time) are subject to Accounting in determining the size of their monetary content, has not changed.
So, in accordance with Part 2 of Article 2 of the Federal Law "On the monetary content of military personnel and the provision of individual payments", the monetary content of the serviceman passing military service under the contract consists of a monthly salary in accordance with the assigned military rank (salary on military rank), monthly Oklade in accordance with the military position (salary in military position), which constitute the salary of the monthly monetary content of the serviceman (salary of monetary content), and from monthly and other additional payments (additional payments), and according to part 34 of the same article, in addition to the payments provided for by it President of the Russian Federation and (or) The Government of the Russian Federation can establish other payments depending on the complexity, volume and importance of tasks performed by military personnel.
As one of the additional payments, the military personnel part 18 of Article 2 of the titled Federal Law provides for a monthly allowance for the special conditions of military service, which is established in the amount of up to 100 percent of the salary for military position and the payment rules of which military personnel under the contract are approved by the Government of the Russian Federations dated December 21, 2011 No. 1073. This monthly allowance is provided, in particular, servicemen undergoing service in compounds (military units, units) of a special (special) appointment, in intelligence compounds (military units, divisions) on the list approved by the state body , and others. Materials that have additionally received by the Constitutional Court of the Russian Federation indicate that such a surcharge received and I.A. Markov - in the amount of 100 percent of the salary at military office (17 500 rubles), and in general, its monetary content as a result of the monetary reform of the monetary system of military personnel increased by almost 2.5 times.
In addition, as can be seen from the complaint and the court decisions attached to it, the right to receive monetary compensation instead of the Days of Recreation I.A. Markov associates with participation in hostilities during the period of business trips to the territory of the North Caucasus region of the Russian Federation. Meanwhile, the participation of a military personnel in combat operations on military service legislation provides special compensation payments in an increased amount on the basis of special regulations. So, certain categories of servicemen, including military servicemen of the Interior Ministry of Internal Affairs of Russia, held military service under the contract and sent to the territory of the North Caucasus region of Russia, Decree of the Government of the Russian Federation of December 29, 2011 No. 1174 "On additional payments to certain categories of military personnel and employees The federal executive bodies "(as was enshrined and previously implemented by the Decree of the Government of the Russian Federation of February 9, 2004 No. 65" On additional guarantees and compensation to military personnel and employees of federal executive bodies participating in counter-terrorism operations and providing law enforcement and public safety in the territory The North Caucasus Region of the Russian Federation ") additional payments are provided to the monetary content. Consequently, there is no reason to believe that with the cancellation of the differentiated surcharge for the special conditions of combat training, the applicant's position worsened and that the features of military service in the military unit of constant readiness remained unaccounted in the new monetary confidence system of military personnel.
4. Thus, paragraph 3.1 of Article 11 of the Federal Law "On the Status of the Servicemen" in itself cannot be considered as violating the constitutional rights of the applicant, since both in the system of invalid the provisions of regulatory legal acts and in the system of valid legal regulation - in determining The amount of monetary satisfaction of the servicemen, he involves the accounting of special conditions of service in the compounds and military units of constant readiness associated with the need to fulfill the duties of military service outside the established duration of the weekly service time.
The resolution of the question of which extent established by current regulatory legal acts for the special conditions of service and other payments provided to the servicemen undergoing service in compounds and military units are compensated for by the cancellation of the differentiated surcharge for special combat training conditions as related to verification The validity of the specified payments provided for by these regulatory legal acts is not included in the competence of the Constitutional Court of the Russian Federation.
Based on the above and guided by Article 36, paragraph 2 of Article 43 and part of the first article 79 of the Federal Constitutional Law "On the Constitutional Court of the Russian Federation", the Constitutional Court of the Russian Federation determined:
1. To recognize the complaint by a citizen Markov Ivan Alexandrovich not subject to further consideration at a meeting of the Constitutional Court of the Russian Federation, since the issue of the Federal Constitutional Law "On the Constitutional Court of the Russian Federation" provided for by Article 71 of the Federal Constitutional Law "On the Constitutional Court of the Russian Federation" is not required.
2. The definition of the Constitutional Court of the Russian Federation on this complaint is not completely appealing.

Additional days of rest compensated for participation in events, which are carried out if necessary, without limiting the total duration of weekly service time. Instead, compensation can be paid. However, the specified additional rest is not provided to those who serve in the compounds and military units of constant readiness translated on the recruitment contracts.
The constitutionality of these provisions challenged a citizen who served in one of these military units and which was refused to pay compensation in return for additional holidays. In his opinion, the above rules allow the inequality of military personnel.
The Constitutional Court of the Russian Federation did not accept the complaint to consider, explaining the following.
For contract soldiers who serve in compounds and military units of constant readiness, elevated requirements have been established, which enhate certain features of the realization of the right to rest. This is due to the intensity of combat training events.
Legal regulation, operating in 2004-2011, provided for such military personnel differentiated premium for special combat training conditions. The applicant received it monthly.
In 2011-2012 A comprehensive reform of monetary content of military personnel was carried out. But now, in determining the amount of monetary satisfaction, special conditions of service are taken into account in the compounds and military units of constant readiness, associated incl. With the need to fulfill the responsibilities of military service outside the established duration of weekly service time.
Thus, for contract soldiers, a monthly allowance for the special conditions of military service (up to 100% of the salary in military position) is provided. This premium received the applicant. At the same time, in general, as a result of the reform, his monetary allowance increased almost 2.5 times.
Therefore, there is no reason to believe that with the abolition of a differentiated surcharge for the special conditions of combat training, the applicant's position worsened. And that the features of the service in the military unit of constant readiness remained unaccounted in the new monetary satisfaction system of military personnel.
219. The distribution of time in the military unit is carried out in such a way that its constant combat readiness has been provided and the conditions for conducting organized combat training of personnel, maintaining military discipline and internal order, upbringing servicemen, increase their cultural level, comprehensive domestic services, timely recreation and reception Food.
The total duration of the weekly service time of military personnel overgoing military service under the contract, except for the cases specified in the third paragraph of this article, should not exceed the duration of weekly working time established by federal laws and other regulatory legal acts of the Russian Federation. The duration of service time of military personnel undergoing military service is determined by the schedule of the midst of the military unit.
Combat duty (combat service), exercises, hiking of ships and other activities, the list of which is determined by the Minister of Defense of the Russian Federation, are carried out if necessary, without limiting the total duration of weekly service time.
Servicemen undergoing military service for call, as well as servicemen undergoing military service under the contract in military professional educational organizations, military educational organizations higher education and training military units are provided for no less than one day holidays weekly. The rest of the servicemen undergoing military service under the contract is provided for no less than one day of recreation weekly, but at least six days of rest per month.
220. Rest days are provided with servicemen on weekends and holidays, and when they are attracting them these days to fulfill the responsibilities of military service, rest is provided on other days of the week.
Servicemen undergoing military service under a contract involved in the fulfillment of military service duties on working days in excess of the time-set duration of weekly service time, as well as events conducted without limiting the total duration of weekly service time, is provided as compensation for rest on other days of the week by the Military Commander Parts (divisions) taking into account the need to maintain combat readiness and interests of the service.
